AI: new Law Commission paper shines light on emerging legal complications

The Law Commission has published a discussion paper examining the emerging legal challenges posed by the growth of artificial intelligence (AI).

The paper, entitled ‘Artificial Intelligence and the Law’, focuses on exploring key areas such as AI autonomy; the implications of relying on AI-generated information; and the risks associated with data used to train AI systems.

It also considers a radical potential solution where AI systems could be granted a form of legal status, thereby allowing them to be sued and held liable.

The purpose of the paper is to raise awareness of the legal challenges, stimulate discussion and identify areas for legal reform.

“Society’s collective legal systems have developed over thousands of years to guide and manage the behaviour of highly intelligent human persons, and subsequently, also non-natural legal persons. It is not yet clear that those same systems will apply equally well to new technology that is also intelligent to varying degrees.”
