Airmic Fest 2020 Delegate Terms and Conditions

Airmic Fest 2020 will be available on the website https://airmicfest.com  (“the Site”) between 22nd and 24th September 2020.  In order to access Airmic Fest users will need to register to obtain a password and user name, and pay any applicable fee.  The delegate passes may be purchased by an individual delegate or their employer (or be provided as part of a participator package).  These terms and conditions will apply to any person who is a delegate at Airmic Fest.

Airmic Limited is the operator of the Site and the provider of Airmic Fest.  Airmic Fest is being hosted for Us by Live Group (Lewis Live Limited).

In order to benefit from the use of the Site and access to Airmic Fest You must agree to these terms and conditions.

In these terms and conditions –

  • 'the Company' 'We' 'Us' 'Our ' 'Ourselves' and Airmic refer to Airmic Limited,
  • ‘You' and 'Your' mean any person given access to the Site.

These terms and conditions apply to the use of the Site, as well as any information accessed or downloaded from the Site. The Site may include links into third party websites and any information, purchases or agreements You enter on those third-party sites will be the responsibility of those third parties.  Additional terms and conditions may apply to any purchases which are made, or services provided by third parties.

Live Group will host the Site and Airmic Fest on Our behalf.  They are entitled to the protections and limits which apply to Us under these terms and conditions.

It is important that You read the terms and conditions as they will apply to You if You use the Site.

Please note by entering the Site you agree to these terms and conditions.  Using the Site does not affect Your statutory rights.

If You are based outside the UK, You will ensure that You are able to use the Site and for Us to process Your data in accordance with UK law. If We cannot You should not use the Site or engage in Airmic Fest.

Section 1 - Terms of Use for Access

You agree to the following terms and conditions for the use of the Site and to participate in Airmic Fest.

Changes to the terms

All of the terms and conditions set out for the Site are subject to change at any time without notice. We will make reasonable efforts to notify You of any significant changes via email, however it is up to You to regularly check the terms and conditions to make sure that You are still able to comply with them. The changes may be in any section of the terms and conditions and will apply from the date We made the change for future transactions and use of the Site.

Acceptance

By registering to participate in Airmic Fest and to use the Site You will agree that You are bound by the current terms and conditions and You should check these each time You use the Site. If You do not accept the terms and conditions or any changes to the terms and conditions You should not continue to use the Site.

Authorisation

Airmic Fest or the Site are provided for users authorised by Airmic who have agreed to the terms and conditions.  They are provided to access the Airmic Fest that is provided by Us including any information, data, benefit offers and other information We will share during Airmic Fest using the Site. By accessing the Site You confirm and agree that You are entitled to access it on this basis.

You agree to comply with all of the Terms of Use and shall only access the Site where You remain authorised to do so.

Content

Whilst We believe the content of the information, data and any offers accessed by the Site or via Airmic Fest to be accurate, We provide no warranties for this and do not accept responsibility for the accuracy or otherwise of any information. Please note in particular that third party information is not confirmed with Us and may be inaccurate, incomplete or out of date. We are not liable in any way for any third-party content. 

The information provided via Airmic Fest and on the Site is not warranted by Airmic and is not designed to provide any form of advice on behalf of Airmic. It is provided for information purposes only and nothing on the pages of the Site or in Airmic Fest shall constitute the provision of professional advice from Airmic in any way.

You agree that where the Site or Airmic Fest allows You to make comments or publish any information You are responsible for it and liable in the event You make any defamatory or inappropriate comments.

Access

Uninterrupted and error free access to the Site is not guaranteed. Nor is the Site guaranteed as virus or bug free and availability may be suspended from time to time for maintenance. It is Your responsibility to ensure that You have the appropriate hardware, software or protection (including virus protection) to enable You to use the Site and download information from it safely and securely.

To use the Site You will need the following:

  • A wired or wireless internet connection
  • Your username and password, created at registration

  • You may need to run the latest updates for your browser

The Site may provide access to links to other websites. These links are provided for Your convenience and/or to access services. We are not responsible for any other sites and You should confirm the basis on which You use those sites (including their content and practices) before using them. You are strongly advised to check any terms and conditions that may be imposed or apply on other sites or for goods/services purchased from them.

The Site and Airmic Fest contains advertising and access to services from participators. Those participators are responsible for their material included on the Site and for their respective products and services.

Where the Site provides links to third party websites these are selected by Us from our participators to provide goods, services or information to You.

Intellectual Property Rights

All intellectual property rights in the Site and Airmic Fest, such as images, graphics, text, logos, databases, trademarks and names and the technology in the Site are reserved to Us or to the relevant owner. No rights are conferred on You or any other person by virtue of these terms and conditions.

You may print a copy of the contents of the pages of the Site for non-commercial use or for the internal purposes of Your business, provided that You keep intact all or any copyright and proprietary notices. Otherwise You may not modify, publish, reproduce, store, utilize or commercially exploit any part of the Site. In particular You are not authorised to use any logo or trademark of Ours or any participator available via the Site.

In the event You provide any content to the Site as part of Airmic Fest You agree that We and the other delegates of Airmic Fest may use this for the purposes of Airmic Fest and in accordance with these terms.

Ownership of Materials

Unless otherwise stated We are the owner or licensee of the copyright and any other rights in the Site, its pages, the screens displaying the pages and all information and material contained herein.

You may not reproduce, republish, transmit or distribute the Site or any content in whole or in part without Our prior consent.

Password Usage

You will choose a password to use the Site. You agree to access Airmic Fest and the Site only using Your own login and password. You agree to keep these confidential to prevent unauthorised access to Airmic Fest. You will inform Us immediately if You know or suspect that Your login or password is no longer secure. Failure to comply may result in access being revoked, suspended or a new password being issued.

You are responsible for the Use of Your login and password. If Your misuse or negligent use of Your login and/or password causes Us (or any other person) any loss You agree to reimburse those losses.

We have the right to disable any such code or password, whether chosen by You or allocated by Us, at any time, if in Our opinion You have failed to comply with any of the provisions of these terms and conditions.

Uploading content to our site

As part of Airmic Fest you may upload content to the Site.  The data will be considered non-confidential and non-proprietary. You retain all of Your ownership rights in Your content, but You are required to grant Us and other users of the Site (including delegates and participators) a limited licence to use, store and copy that content and to distribute and make it available to third parties.

We have the right to remove any posting You make on the Site if, in Our opinion, Your post does not comply with Our standards.

Rights you are giving us to use material you upload

When You upload or post content to our site, you grant us a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that content in connection with the provision of Airmic Fest.

General – these terms apply to all sections of the Terms and Conditions

If any of these terms and conditions are found to be unlawful or unenforceable, they shall be deleted to the extent required to remove such illegality or unenforceable element and the remaining terms and conditions shall be unaffected.

Any failure to exercise or delay in exercising a right or remedy by Us shall not prevent Us from taking further action on any subsequent occasion.

We make no promise that materials accessed by the Site or in Airmic Fest are appropriate or available for use outside the United Kingdom and accessing the Site from territories where its contents are illegal or unlawful is prohibited. If You choose to use the Site or Airmic Fest from locations outside the United Kingdom, You do so on Your own initiative and are responsible for compliance with local laws.

You agree to use the Site on the basis it was designed for; use by individuals attending Airmic Fest. In particular (without being limited) You agree not to attempt to disassemble, decompile, reverse-engineer, create derivative works or attempt to fraudulently access any part of or service available on or via the Service.

You agree not to use the Site in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms and conditions, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, into the Site, any service or any operating system.

We shall not be responsible for any breach of any term caused by circumstances beyond Our reasonable control.

Use of Your personal information is set out in our Privacy Policy. As part of these terms of use You agree to the terms and conditions in Our Privacy Policy.

We advise You never to enter Your password for the Site, bank card or bank account details into an email. We will never solicit such information from delegates by email or at all.

We cannot be held responsible in the unlikely event of Phishing by any third party.

Phishing refers to an email that attempts to fraudulently acquire personal information from you, such as your password and/or credit card information. On the surface, the email may appear to be from a legitimate company or individual, but it's not.

If You are concerned that Your password has been compromised then please contact the support team at enquiries@airmic.com or for any other concerns.

Nothing in these terms of use shall operate to confer any right or benefit on any third party other than Live Group.

If We are in breach of these terms of use, We will only be responsible for any actual losses that You suffer as a result to the extent that they are a foreseeable consequence to both of us at the time You use the Site and are not excluded under the terms of use. Our liability shall not in any event include business losses such as lost data, lost profits or business interruption and consequential loss.

We do not exclude any liability for death, personal injury or fraud. Any other losses are excluded to the fullest extent permitted by law.

These terms and conditions shall be governed by and construed in accordance with laws of England and Wales.

If You have a complaint regarding the site or services provided on the site, please send Us a ‘Support Request’ to enquiries@airmic.com and our support team will review Your complaint and respond to You within 3 business days.
