This session will explore recent authorities on the interpretation of pollution exclusions and accidental vs. deliberate conduct, including the Judgment in the US case of Petroleum Ltd. v. National Union Fire Insurance Co. of Pittsburgh, and whether the English Courts would have reached the same conclusions. It will also cover coverage issues arising from weather events, including whether the insured peril is storm or flood.
By the end of the session, you will be able to:
- Have a better understanding of how the Court will approach pollution exclusions and reckless and deliberate conduct
- Recognise the Court’s approach to classifying weather events for the purpose of insurance coverage
- Identify some of the potential trends in relation to climate change insurance coverage issues
