Airmic Statement of Principles

Airmic and various Insurers have reviewed the question of when and how a reservation of rights (“ROR”) should be used. This review has been undertaken in a spirit of partnership and the aspiration is that all stakeholders can work together to achieve a pragmatic approach that is fair to all. There are circumstances in which a ROR is necessary in order to protect the parties’ positions, but care needs to be taken to ensure that it is not over-used and that when it is considered necessary a dialogue takes place so that the parties are fully aware of the reasons.
